Website Disclaimer

Effective Date: July 11, 2026 · Last Updated: July 11, 2026

This Website Disclaimer applies to the website operated by Montserrat Aspirers, Inc. (“Montserrat Aspirers,” “Organization,” “we,” “us,” or “our”), currently available at https://www.aspirers.org (the “Website”). By accessing or using the Website, you acknowledge that you have read and understood this Disclaimer. Additional terms, eligibility requirements, consent forms, program rules, scholarship guidelines, and donation conditions may apply to particular services or activities.

1. General Information Only

The information provided through this Website is intended for general informational, educational, charitable, and community-engagement purposes only.

Although Montserrat Aspirers makes reasonable efforts to provide accurate and current information, we do not represent or warrant that all Website content is complete, accurate, current, suitable, or available at all times. Information concerning programs, scholarships, events, donations, volunteer opportunities, membership, and other activities may be revised without prior notice.

Your use of and reliance upon information available through the Website is at your own discretion and risk.

2. No Professional Advice

Nothing on this Website constitutes legal, financial, tax, medical, mental-health, educational, or other professional advice.

Information concerning scholarships, charitable contributions, children’s programs, or educational opportunities is general in nature and may not apply to every person’s circumstances. You should consult an appropriately qualified professional before making a decision that requires professional advice.

3. Scholarships and Educational Opportunities

Montserrat Aspirers may publish information about scholarships, grants, educational assistance, mentorship opportunities, or other forms of support. Unless expressly stated otherwise in the applicable scholarship rules:

  • Scholarship opportunities are subject to the stated eligibility requirements, deadlines, availability of funding, and selection criteria.
  • Submission of an application does not guarantee that the application will be reviewed, accepted, approved, or funded.
  • Applications may be rejected if they are incomplete, inaccurate, misleading, submitted after the deadline, or do not meet the applicable eligibility requirements.
  • Applicants are responsible for ensuring that all required information and supporting documents are complete, accurate, and submitted on time.
  • Montserrat Aspirers may request additional information and may verify information provided in an application, including educational, residency, financial-need, or eligibility information, where appropriate.
  • Scholarship amounts, selection criteria, deadlines, award dates, and the number of available awards may be changed when reasonably necessary, subject to applicable law and any published scholarship rules.
  • Unless the applicable scholarship rules provide otherwise, scholarship determinations made in good faith under the published selection criteria are final.
  • An application does not create a contract, fiduciary relationship, entitlement, or legally enforceable promise that an applicant will receive an award.
  • Applicants must not submit Social Security numbers, bank-account details, medical records, or other highly sensitive information unless a form specifically requests that information through an approved and secure submission process.
  • Montserrat Aspirers is not responsible for applications or supporting materials that are lost, delayed, corrupted, misdirected, incomplete, or not received because of internet interruption, system failure, file incompatibility, incorrect contact information, or another technical problem outside our reasonable control.

Any scholarship is also subject to its separately published rules, award conditions, and applicant certifications. If this Disclaimer conflicts with the specific written rules of a scholarship, the specific scholarship rules will control with respect to that scholarship.

4. Children’s Programs and Registration

Montserrat Aspirers may offer educational, recreational, mentorship, community, or enrichment programs for children, including children in kindergarten through fifth grade.

Registration does not guarantee acceptance, placement, attendance, or continued participation in any program. Programs may be limited by capacity, eligibility, staffing, funding, location, age, grade level, safety considerations, or other reasonable operational requirements.

A child’s registration must be completed or expressly authorized by the child’s parent or legal guardian. The parent or guardian is responsible for providing complete and accurate information, including any requested:

  • Emergency-contact information;
  • Allergy, medical, accessibility, or accommodation information;
  • Authorized-pickup information;
  • School and grade-level information; and
  • Other information reasonably necessary for the child’s safety and participation.

Parents and guardians must promptly notify Montserrat Aspirers if relevant information changes.

Participation may be subject to separate enrollment terms, parent or guardian consent, emergency authorization, health and safety requirements, codes of conduct, media choices, and activity-specific waivers. This Website Disclaimer does not replace those separate documents.

To the extent permitted by applicable law, Montserrat Aspirers may suspend or end a participant’s involvement when reasonably necessary to protect the safety or welfare of participants, staff, volunteers, or others; address serious or repeated misconduct; enforce program requirements; or respond to circumstances that materially interfere with program operations.

5. Programs, Events, and Activities

Programs, community initiatives, workshops, mentorship activities, meetings, and events described on the Website may be changed, postponed, relocated, conducted virtually, restricted, or cancelled.

Dates, times, locations, instructors, speakers, volunteers, schedules, capacity, and program content are subject to reasonable change. Montserrat Aspirers does not guarantee that any particular program, event, instructor, speaker, service, or opportunity will remain available.

Where a program or event has separate registration terms, safety rules, cancellation conditions, or participation requirements, those terms will apply in addition to this Disclaimer.

6. Health and Safety

Participation in an in-person or virtual program may involve ordinary risks associated with educational, community, recreational, transportation, or group activities.

Parents, guardians, and adult participants are responsible for reviewing the nature of the relevant activity and disclosing information reasonably necessary to support safe participation. Montserrat Aspirers does not provide medical diagnosis or treatment through this Website.

In an emergency, Montserrat Aspirers may take reasonable steps consistent with the information and authorization provided during registration. Any emergency or medical authorization will be addressed through a separate form where required.

Nothing in this Disclaimer excludes or limits any responsibility that cannot lawfully be excluded.

7. Donations and Charitable Contributions

Donations made through the Website are voluntary. Donations may be processed by an independent payment processor, and the processor’s terms and privacy practices may also apply.

Montserrat Aspirers does not receive or retain complete payment-card information when payment information is submitted directly to an independent payment processor, provided that the Website’s payment system is configured in that manner. The Organization may nevertheless receive information such as the donor’s name, contact details, donation amount, transaction date, transaction identifier, recurring-donation status, and limited payment information.

Unless otherwise required by law or stated in a specific fundraising campaign:

  • Donations are generally final and non-refundable.
  • A donor should promptly contact Montserrat Aspirers concerning a duplicate, mistaken, or unauthorized transaction.
  • Montserrat Aspirers may refuse, return, or redirect a donation when accepting or using it would be unlawful, impracticable, inconsistent with the Organization’s charitable mission, administratively burdensome, or subject to restrictions the Organization cannot honor.
  • If a designated campaign or program becomes fully funded, discontinued, impracticable, or no longer capable of using the funds as originally anticipated, Montserrat Aspirers may use the donation for a substantially similar charitable purpose or, where permitted, for its general charitable programs.
  • A donor may not impose a binding restriction on a donation unless Montserrat Aspirers expressly accepts that restriction in writing through an authorized representative.
  • Donors should retain donation receipts and other records. The availability and amount of any tax deduction depend on the Organization’s tax status, the nature of the contribution, any goods or services received, and the donor’s individual circumstances.
  • Montserrat Aspirers does not provide tax advice and does not guarantee that a particular donation will be deductible. Donors should consult a qualified tax professional.
  • Where required, Montserrat Aspirers will provide an appropriate acknowledgment or disclosure regarding a contribution. Any receipt or acknowledgment does not constitute a valuation of donated property or individualized tax advice.
  • Recurring donations, if offered, will continue according to the authorization given at the time of donation until cancelled through the available cancellation method. Cancellation will ordinarily apply to future payments and will not automatically refund payments already processed.

8. Photographs, Videos, and Media

Montserrat Aspirers may photograph or record certain public events and organizational activities for educational, historical, reporting, fundraising, or promotional purposes.

When identifiable photographs, recordings, testimonials, or personal stories of minor participants are to be used, Montserrat Aspirers will seek appropriate permission from a parent or legal guardian as required by its enrollment or media-release process.

Consent to a child’s participation in a program will not automatically be treated as consent to promotional use of that child’s image unless the applicable form clearly states otherwise and the parent or guardian affirmatively provides that consent.

Parents and guardians should review the applicable media choices and may contact Montserrat Aspirers concerning withdrawal of consent for future uses. Withdrawal ordinarily will not require the Organization to recall materials lawfully created, printed, distributed, or published before the withdrawal was received, where removal is not reasonably practicable.

9. Testimonials and Success Stories

The Website may contain testimonials, participant experiences, scholarship-recipient profiles, success stories, or examples of program outcomes.

These materials reflect individual experiences and do not guarantee that another participant, applicant, or recipient will achieve the same or a similar result. Outcomes depend on individual circumstances, eligibility, participation, available resources, and other factors.

Montserrat Aspirers will obtain appropriate authorization before publishing identifiable personal stories or images where consent is required.

10. External Links and Third-Party Services

The Website may contain links to third-party websites, platforms, forms, payment processors, social-media services, educational resources, or other external services.

14. No Warranties

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis.

Montserrat Aspirers disclaims express and implied warranties concerning the Website, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, non-infringement, and security, to the extent those warranties may lawfully be disclaimed.

This provision does not exclude any warranty or right that cannot be excluded under applicable law.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Montserrat Aspirers and its directors, officers, employees, volunteers, representatives, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to:

This Disclaimer does not replace or override any specific written agreement, scholarship rules, donation terms, enrollment conditions, consent form, or waiver issued by Montserrat Aspirers.

16. Indemnification

To the fullest extent permitted by law, an adult user agrees to be responsible for reasonable losses, claims, or expenses arising directly from that user’s unlawful misuse of the Website, intentional submission of false or unauthorized information, infringement of another person’s rights, or material violation of this Disclaimer.

This provision does not apply to the extent a claim results from the negligence, unlawful conduct, or willful misconduct of Montserrat Aspirers.

17. Changes to the Website or This Disclaimer

Montserrat Aspirers may update the Website and this Disclaimer from time to time to reflect changes in its programs, practices, technology, or legal obligations.

The revised Disclaimer will be posted on this page with an updated effective or revision date. Material changes will apply prospectively unless applicable law permits otherwise.

Users are encouraged to review this page periodically.

18. Governing Law

This Disclaimer is governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Nothing in this section deprives a user of a mandatory right or protection available under applicable law that cannot lawfully be waived.

19. Severability

If any provision of this Disclaimer is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law, and the remaining provisions will remain in effect.
